Bad Democrat

How can liberals use a conservative Supreme Court to their advantage?

The Supreme Court’s line of questioning on Trump’s tariffs is putting me in a good mood about the Supreme Court.

“Is it your contention that every country needed to be tariffed because of threats to the defense and industrial base?” asked Justice Amy Coney Barrett. “I mean, Spain? France?”

It got me thinking about how democrats and independents could use a conservative Supreme Court to their advantage.

One example I’m thinking of is tort law: laws concerning intentional wrongs, negligence, and liability. Conservatives have historically been strong on tort law. It makes them consider questions of individual responsibility. While liberals may reject extreme individual blame, in tort law, conservatives can too if it’s unfair. Tort law concerns bad businesses. If someone is being taken advantage of by a business, that gets at liberals’ sense of justice through fighting for the underdog.

If there’s someone out there with a case they think could get at liberals’ justice paradigm while still being ruled on positively by the conservative Supreme Court, maybe they should send it up through the ranks.

‘How could liberals use a conservative Supreme Court to their advantage?’ is a question we haven’t really thought about yet.
